1. Acceptance

By accessing this website or submitting an enquiry through it, you accept these terms. If you do not accept them, please do not use the site.

2. Who operates this site

This site is operated by DigiExplorer Branding Solution, registered with the Uttar Pradesh Real Estate Regulatory Authority as a real estate agent under UPRERAAGT15197. We market Evara Shades as an authorised channel partner of the promoter, Shades Infratech LLP.

This is not the official website of the promoter. We are an independent marketing partner. We are not the developer, the builder, the architect or the contractor, and we do not construct, own or sell the property ourselves.

3. This is not an offer

The content of this website is for general information only. It does not constitute an offer, an invitation to offer, a solicitation, a warranty, or any part of a contract for the sale of any unit. No binding obligation arises between you and us, or between you and the promoter, from anything on this site or from submitting an enquiry.

A binding relationship arises only on execution of a formal, written Agreement for Sale in the form prescribed under the Real Estate (Regulation and Development) Act, 2016 and the Uttar Pradesh rules made under it, duly registered as required by law.

4. Accuracy of information

We take reasonable care to keep information here accurate and current, and it is drawn from material supplied by the promoter. Even so:

• All images, renders, walkthroughs, elevations and site plans are artists' impressions. They are conceptual and will differ from the finished product.
• All areas quoted are RERA carpet areas as published by the promoter, and remain subject to final measurement, architectural revision and regulatory approval.
• All amenities and specifications are proposed. They may be changed, substituted or withdrawn by the promoter at its sole discretion, in consultation with the architect.
• All travel times and distances are approximate, sourced from publicly available mapping tools, and vary with traffic, route and time of day.
• All prices, charges, payment plans, offers and inventory are subject to change without notice, and units are subject to availability at the time of booking.

We make no representation or warranty, express or implied, as to the completeness or accuracy of any of it. You must verify everything that matters to you before committing.

When you submit an enquiry, you authorise us and the promoter to contact you by phone, SMS, WhatsApp and email at the details you provided, in connection with this project. This consent applies even if the number is registered on the National Do Not Call registry, and it overrides any such registration for the purposes of this enquiry.

8. Acceptable use

You agree not to:

• Submit false, misleading or third-party contact details without that person's consent.
• Use automated tools to scrape, harvest, spam or overload the site.
• Attempt to gain unauthorised access to the site, its database or its hosting.
• Reproduce, republish or commercially exploit any content from this site without our written permission.
• Use the site for any unlawful purpose or in breach of any applicable Indian law.

9. Intellectual property

"Evara Shades", "Shades Infratech", the associated logos and the project imagery are the property of Shades Infratech LLP and are used here under authorisation for marketing purposes. Site design, layout, text and code are owned by DigiExplorer Branding Solution. Nothing here grants you a licence to use any of it.

This site embeds and links to third-party services including Google Maps, Google Fonts and the UP RERA portal. We do not control them and are not responsible for their content, availability or practices.

11. Limitation of liability

To the fullest extent permitted by law, DigiExplorer Branding Solution accepts no liability for any direct, indirect, incidental, consequential or punitive loss arising from your use of this website or reliance on its content — including loss of profit, loss of opportunity, or loss arising from any decision to purchase or not to purchase.

The site is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free or free of harmful components.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded.

12. Obligations of the promoter

Construction, quality, specification, delivery, possession, title and every other obligation relating to the project rest solely with the promoter, Shades Infratech LLP, under the Agreement for Sale and the Real Estate (Regulation and Development) Act, 2016. As a channel partner our role is limited to marketing and facilitating introductions. We do not assume, and cannot discharge, the promoter's obligations.

13. Changes to these terms

We may revise these terms at any time. The revised version takes effect when published on this page and the "Last updated" date changes. Please check back before relying on them.

14. Governing law and jurisdiction

These terms are governed by the laws of India. Disputes relating to this website are subject to the exclusive jurisdiction of the courts at Lucknow, Uttar Pradesh. Disputes relating to the project itself are subject to the Real Estate (Regulation and Development) Act, 2016 and the jurisdiction of the Uttar Pradesh Real Estate Regulatory Authority.
